About these Terms
These Terms and Conditions (“Terms”) govern your access to and use of HerBridal.com and its related features and services (together, the “Services”).
HerBridal.com is operated by FAMEFUNDING PTE. LTD., registered in Singapore under UEN 201014772Z (“HerBridal”, “we”, “us” or “our”).
By creating an account or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Our Community Guidelines and any additional terms shown for a particular feature or purchase also apply. Our Privacy Policy explains how we handle personal information.
What HerBridal Provides
HerBridal is an online platform where users may create and share wedding chronicles, engagement and proposal stories, photographs, videos and other memories. The Services may also include digital invitations, guest lists, RSVP tools, public browsing, search and related features.
HerBridal provides the platform and does not act as a wedding planner, matrimonial service, professional adviser or agent for users, guests, venues, photographers or vendors. We are not a party to arrangements made between users and third parties.
Features may change as the Services develop. Some features may not be available in every country, language or device.
Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a contract to create an account.
You must provide accurate account information and keep it reasonably current. You are responsible for protecting your login details and for activity carried out through your account. Please notify us promptly at [SECURITY EMAIL] if you believe your account has been used without permission.
You may not sell or transfer your account. If an account permits collaborators, the account owner is responsible for choosing them and managing their access. We may treat instructions from the account owner as final and are not responsible for disputes between collaborators, partners, family members or other account users.
We may refuse or cancel registrations, require reasonable verification or reject usernames that are misleading, unlawful or likely to cause confusion.
Your Content
“User Content” means photographs, videos, audio, stories, comments, invitations, guest information, messages and any other material submitted through the Services.
4.1 Ownership
You retain any ownership rights you have in your User Content. HerBridal does not claim ownership merely because you upload it.
4.2 Permission to operate the Services
You grant HerBridal a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, transmit and otherwise process your User Content as reasonably necessary to:
- provide and operate the Services;
- display or share it according to your settings and instructions;
- maintain security and prevent misuse;
- address technical or legal issues; and
- comply with applicable law.
This licence lasts while the content remains on the Services and for a reasonable period afterwards where copies remain in backups or must be retained for security, legal or operational purposes.
If you make content public, you also allow HerBridal to display previews, thumbnails, titles and links within the Services so that other users can discover it. We will not use private or link-restricted content in external advertising without separate permission.
4.3 Your responsibilities
You are responsible for your User Content. You confirm that:
- you own it or have the permissions needed to upload and use it;
- it does not infringe another person’s copyright, privacy, publicity, contractual or other rights;
- you have appropriate permission from identifiable people, photographers and videographers;
- where children appear, you have any permission required from a parent or guardian; and
- uploading and sharing it complies with applicable law.
HerBridal is not responsible for obtaining permissions on your behalf.
Privacy and Visibility Settings
Depending on the feature, you may be able to make content:
- private to you and authorised collaborators;
- available to invited recipients or people with a link; or
- public.
You are responsible for checking the selected setting before sharing content.
A link-restricted page is not completely confidential. A recipient can forward the link, take a screenshot or copy content. Public content may be indexed by search engines or copied by others. Changing a setting limits future access through HerBridal but cannot retrieve copies already made by another person.
HerBridal applies available visibility settings through the Services but cannot guarantee that a person with access will not copy or redistribute content.
Invitations, Guests and RSVPs
If you provide another person’s name, contact details, dietary needs, accessibility information or other personal information, you confirm that you are entitled to provide and use that information for the relevant event.
You are responsible for:
- the accuracy of guest details;
- providing any notice and obtaining any permission required by law;
- the content and recipients of invitations and messages; and
- using guest information only for legitimate event-related purposes.
You must not use invitation or messaging features for spam, unlawful marketing, harassment or deceptive communications.
Invitation and message delivery is not guaranteed. Communications may be delayed, filtered, rejected or sent to an outdated or incorrect address. Do not rely on the Services for emergency or legally significant communications.
Acceptable Use
You must not use the Services to:
- break the law or violate another person’s rights;
- upload material you do not have permission to use;
- harass, threaten, stalk, impersonate, defame, exploit or deceive anyone;
- disclose another person’s private or sensitive information without authority;
- publish child sexual abuse material, non-consensual intimate content or sexual content involving minors;
- promote terrorism, serious violence, suicide, self-harm, trafficking, organised crime or unlawful goods or services;
- publish unlawful hate content or incite violence or discrimination;
- distribute spam, phishing, malware or unsolicited commercial messages;
- manipulate identities, reviews, rankings, engagement or RSVPs;
- access another account or restricted content without permission;
- scrape or extract data or content at scale without our written permission;
- use content obtained from the Services to train an artificial-intelligence model without the permission of HerBridal and the relevant rights holders;
- bypass security measures, probe vulnerabilities, overload the Services or interfere with their operation; or
- suggest falsely that HerBridal sponsors, verifies or endorses you or your content.
Content Moderation
HerBridal may review, restrict, label, refuse, remove or preserve content, and may limit, suspend or close accounts, where we reasonably believe this is appropriate to:
- enforce these Terms or our Community Guidelines;
- comply with law or a valid legal request;
- protect users, third parties, HerBridal or the public;
- investigate fraud, infringement, abuse or security concerns; or
- maintain the integrity and operation of the Services.
We may act without advance notice where the matter is urgent, notice would create a risk or the law permits or requires us to do so.
HerBridal is not required to monitor every item of User Content and does not endorse content merely because it appears on the Services.
Content or conduct may be reported through [REPORTING FORM OR EMAIL]. A report does not guarantee removal or a particular outcome. Where applicable law requires reasons or an appeal process, we will provide the required procedure.
Intellectual Property Complaints
If you believe content on HerBridal infringes your copyright, trademark, privacy, publicity or other rights, contact [RIGHTS EMAIL OR FORM] with:
- your name and contact details;
- identification of the protected work or right;
- the location of the disputed content;
- an explanation of the alleged infringement; and
- confirmation that the report is accurate and made in good faith.
We may send the report to the affected user. A person submitting a knowingly false or misleading report may be legally responsible for doing so.
US copyright notices under the Digital Millennium Copyright Act should be sent to:
DMCA agent: [NAME]
Address: [ADDRESS]
Email: [EMAIL]
Telephone: [NUMBER]
Notices and counter-notices must contain the information required by applicable US law. HerBridal may terminate repeat infringers in appropriate circumstances.
HerBridal’s Intellectual Property
HerBridal and its licensors own the Services, including the software, design, branding, interfaces, databases and content created by HerBridal.
We grant you a limited, personal, non-exclusive and revocable right to use the Services for their intended purposes, subject to these Terms. You may not copy, sell, licence, reverse engineer or commercially exploit the Services except with our written permission or where applicable law expressly permits it.
The HerBridal name, logos and branding may not be used without prior written permission.
If you voluntarily provide feedback or suggestions, HerBridal may use them without restriction or payment.
Paid Features
Some features may be offered for a fee. The applicable price, currency, billing period and material purchase terms will be shown before payment.
You authorise HerBridal and its payment provider to charge your selected payment method, including applicable taxes and any recurring charge disclosed at checkout.
If a subscription renews automatically, it will continue at the disclosed interval until cancelled. You may cancel through [ACCOUNT PATH OR CONTACT METHOD]. Cancellation normally takes effect at the end of the current paid period.
Payments are non-refundable unless:
- the applicable offer states otherwise;
- HerBridal agrees to a refund; or
- a refund is required by applicable law.
We may change future prices by giving reasonable notice. If payment fails, we may retry the payment or suspend the relevant paid feature.
Third-Party Services
The Services may contain links to or integrations with payment providers, social networks, maps, messaging services, vendors, venues and other third parties.
HerBridal does not control or guarantee third-party products, services, content, availability or conduct. A link, listing or integration does not by itself mean that HerBridal endorses the third party.
Your dealings with third parties are between you and them and may be governed by their own terms. HerBridal is not responsible for third-party acts or omissions except to the extent responsibility cannot lawfully be excluded.
Availability and Backups
We work to maintain the Services but do not guarantee uninterrupted, error-free or permanent availability. Maintenance, technical failures, security incidents, supplier failures and events beyond our control may cause interruption or data loss.
HerBridal is not intended to be the only archive for important photographs, videos, guest lists or other content. You should maintain independent copies.
We may introduce, change, limit or discontinue features. If a change materially affects a paid feature, we will provide any notice or remedy required by applicable law.
Beta or preview features may be incomplete, changed or withdrawn at any time.
Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the extent permitted by law, HerBridal does not guarantee:
- that the Services will always be secure, uninterrupted or error-free;
- that User Content is accurate, lawful, complete or authentic;
- that any user, vendor, venue, photographer or other third party is suitable or trustworthy;
- that invitations, reminders or messages will reach their recipients;
- that visibility controls will prevent all copying or disclosure; or
- that use of the Services will produce any particular result.
Content on HerBridal is provided for general information and inspiration. It is not legal, financial, medical, relationship, safety, wedding-planning or other professional advice.
Nothing in these Terms excludes a warranty, guarantee or right that cannot lawfully be excluded.
Limitation of Liability
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be limited.
To the extent permitted by law, HerBridal will not be liable for:
- indirect, incidental, special or consequential loss;
- loss of profit, revenue, opportunity, goodwill, anticipated savings or data;
- loss, deletion, corruption, copying or disclosure of User Content;
- acts, omissions, content, products or services of users or third parties;
- missed, delayed or incorrect invitations, messages, RSVPs or event arrangements; or
- interruption, failure or unauthorised access beyond our reasonable control.
To the extent permitted by law, HerBridal’s total liability arising from the Services or these Terms will not exceed the greater of:
- the amount you paid directly to HerBridal during the 12 months before the event giving rise to the claim; and
- SGD 100.
Responsibility for Claims
If your unlawful User Content, misuse of the Services, material breach of these Terms or infringement of another person’s rights causes a claim against HerBridal, you will be responsible for the resulting losses and reasonable legal costs to the extent permitted by law.
HerBridal will give reasonable notice of the claim and will not agree to a settlement that imposes a non-monetary obligation or admission on you without your agreement.
This section does not apply where the claim was caused by HerBridal or where applicable consumer law does not permit it.
Suspension and Account Closure
You may stop using the Services or close your account through [ACCOUNT PATH OR CONTACT METHOD].
HerBridal may restrict, suspend or close an account if:
- these Terms or the Community Guidelines are materially or repeatedly breached;
- payment remains outstanding;
- the account creates a legal, safety, security or operational risk;
- we reasonably suspect fraud, infringement or unauthorised access;
- the account has been inactive for [PERIOD]; or
- the relevant Service is discontinued.
Where appropriate, we will provide notice. We may act immediately in serious or urgent cases.
Account closure does not remove payment or other obligations already incurred. Provisions concerning ownership, licences, liability, claims and disputes continue where their nature requires it.
Changes to These Terms
We may update these Terms to reflect changes in law, security, technology, features or business operations.
The updated Terms will be posted with a revised date. If a change materially affects existing users, we will provide reasonable notice where required. Continued use after the effective date constitutes acceptance where permitted by law.
If you do not accept an update, you may stop using the Services and close your account.
Governing Law and Jurisdiction
These Terms and any dispute arising from them or the Services are governed by the laws of Singapore. The courts of Singapore will have exclusive jurisdiction, subject to any applicable law that cannot be excluded by agreement.
General
These Terms and applicable feature-specific terms constitute the agreement between you and HerBridal concerning the Services.
If a provision is found invalid or unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver.
You may not transfer your rights under these Terms without our consent. HerBridal may transfer its rights and obligations as part of a restructuring, financing, merger, acquisition or sale of the relevant business.
HerBridal is not responsible for delay or failure caused by events beyond its reasonable control.
No third party may enforce these Terms under the Contracts (Rights of Third Parties) Act 2001 of Singapore.
If these Terms are translated, the English version will control to the extent permitted by law.
